How to Use GPS and Avoid Distracted Driving Penalties



In the trucking industry, GPS technology has become an indispensable tool for truck drivers and fleet operators. However, improper use can lead to fines and penalties in California, especially for distracted driving. With strict regulations governing electronic devices, it´s essential for drivers to understand how to use these systems safely and legally.


California Vehicle Code Section 23123.5 prohibits operating a motor vehicle while holding or manually using a handheld electronic device, including cell phones and GPS units. This law applies to both private motorists and commercial vehicle operators.


While GPS use is allowed, the device must be properly mounted and cannot be manually operated while driving. Entering an address or adjusting a route by hand while the vehicle is in motion can be considered distracted driving, punishable by fines starting at $162 or more, along with points added to the driver´s license.


How to Use GPS Legally and Safely


To operate a GPS legally in California, follow these guidelines:



  • Mount the Device Securely: The GPS must be installed in a position that does not obstruct the driver´s view — preferably on the dashboard or the lower corner of the windshield. California law permits placement as long as it does not interfere with the driver´s line of sight.

  • Set Your Destination Before Driving: Enter the address and review the route before moving the vehicle. Making adjustments while driving is considered illegal handling of the device.

  • Use Voice Commands: If your GPS system supports voice commands or hands-free control, use it. This allows you to interact with the device without taking your hands off the wheel or your eyes off the road.

  • Pull Over to Make Adjustments: If you need to recalibrate your route, do so safely by pulling over at a rest stop or another designated safe area.

  • Prefer Integrated Systems: Built-in GPS systems in truck dashboards typically comply with all installation and usage regulations. Many also offer compatibility with FMCSA regulations and fleet management systems.


Distraction Is Punishable


Even a momentary distraction can cause an accident.


The California Highway Patrol (CHP) conducts regular enforcement operations, and any behavior that results in loss of visual, manual, or cognitive control of the vehicle can be penalized.
