Joshua H. Haffner, an attorney based in L.A, was responsible for filing two lawsuits against transportation companies during the recent months. The one filed last November is against KLLM Transport Service LLC. in defense of drivers from Florida and California. The other, filled last December, is charging K&R Transportation LLC of Wilmington.
The allegations on both cases are related to labor law violations, wage and hour infractions committed by those trucking companies. These lawsuits pursue a class action status with the objective to provide to truckers back pay, liquidated damages, lawyer’s fees, pre-judgment interest. And also for the case of drivers who are now unemployed, waiting time penalties.
Haffner, who specializes in labor lawsuits against trucking companies, alleged on the lawsuits that truckers are misclassified as independent contractors when hired, apparently a normal practice by transportation companies. The misclassification strategy looks for an evasion of the obligations that an employer has with his employees, such as insurance, trailer’s cost, fuel, maintenance.
Without saying, there are cases where truckers are pushed by trucking companies to sign lease agreements thus tying up the vehicles to those companies and prohibiting them to work for other employers with the truck.
